Job Description

We are pleased to announce an exciting new career opportunity for an In-House Lawyer, specialised in Products & Regulation. The successful incumbent will act as a legal advisor to management and our business on legal and regulatory matters (mainly including open banking and FCA requirements). You'll be an integral part of the organisation; leading relationships between the legal team and the relevant designated Experian business unit.

So, what will you be tasked with?

Providing Core Legal Advice

  • Provide clear legal advice and insight on open banking and FCA regulatory matters as needed by Experian to launch or update products at pace and within risk appetite through providing challenge and support to the first line of defence, compliance team and, as appropriate, other teams within Experian.
  • Monitor the regulatory directions and actions of the FCA and relevant legislatures.
  • Collaborate with legal and compliance colleagues to find ways to empower the first line of defence to get compliant products into client's hands at pace.

Associated Legal Advice 

  • Identify and provide preliminary advice on associated legal issues (including, for example, privacy, Brexit, competition law issues, intellectual property, discrimination & fairness, risks of legal proceedings).
  • Demonstrate strategic or specialist knowledge reasons, to obtain external legal advice (through a competitive fee challenge approach where appropriate)

Business Relationship Management 

  • Act as the primary relationship contact between the legal team and a designated business unit
  • Seek to understand the strategic direction, needs and priorities of that business unit and join forces with them
  • Support the business unit understand its legal and regulatory obligations and help those feed into its strategic direction
  • Share and capture knowledge about the business unit for the benefit of the whole legal team
  • Take accountability for overseeing and tracking the work across the legal team for that business unit – escalating and influencing as necessary
  • Collaborate with colleagues across the team, business unit and wider Experian to help ensure that desired outcomes get delivered

Governance and Control

  • Adhere to all regulatory requirements within role responsibility and escalate issues quickly
  • Pro-actively identify risks and make recommendation to mitigate these
  •  Understand and adhere to specific regulatory obligations and company policies and procedures.

Qualifications

Qualifications

Applicants must be a Solicitor, barrister or chartered legal executive (in England & Wales, Northern Ireland or Scotland), qualified as a lawyer in a member state of the European Union or qualified as a lawyer in another common-law jurisdiction.

Technical

  • At least 5 years post-qualification experience of advising on regulated products
  • Demonstrated experience of aspects of payment services regulation (PSD, PSD2) including account information services
  • Some experience of 'emoney' regulations and an understanding of AML requirements
  • GDPR and UK Data Protection Act 2018 advantageous; must demonstrate a commitment to the use of IT and automated systems to assist in the delivery of legal services, and an understanding of the importance of knowledge management

Experience

  • Experience of working as an in-house lawyer highly desirable in a "business partnering" manner 
  • Experience of working in a business regulated by the Financial Conduct Authority highly desirable
